Cherokee Nation Sex Offender Registration

Delaware County has a large Cherokee Nation population. Much of the county falls within the Cherokee Nation reservation boundary. Because of this, sex offender registration in Delaware County involves two systems: the Oklahoma state registry and the Cherokee Nation sex offender registry.

Tribal members who live on trust land may register with Cherokee Nation law enforcement. However, all offenders must also comply with state registration requirements under Oklahoma law. The Cherokee Nation registry feeds into the national NSOPW database, so federal and state searches will still show tribal registrants. If you are searching for someone you believe lives on tribal land, check both the state registry and the Cherokee Nation registry directly.

The interaction between tribal sovereignty and state registration law has been a complex legal area in Oklahoma, especially after the 2020 McGirt decision. The short version for most people looking up offenders: search both systems to be sure you have complete results for Delaware County.

Registration Requirements in Delaware County

Oklahoma has required sex offender registration since 1989. The rules are set out in 57 O.S. Sections 581 through 590.2. The law sets three risk levels, each with different check-in schedules.

Risk LevelLevel 1 (Low Risk)
Check-in ScheduleOnce per year
Registration Period15 years
Risk LevelLevel 2 (Moderate Risk)
Check-in ScheduleEvery 6 months
Registration Period25 years
Risk LevelLevel 3 (High Risk)
Check-in ScheduleEvery 90 days
Registration PeriodLifetime

Habitual sex offenders and those with aggravated convictions also register for life and must check in every 90 days. Failure to register is a felony in Oklahoma. A first violation can mean up to five years in prison.

Transient offenders with no fixed address must report to local law enforcement every 7 days. If someone moves to Delaware County from another state and stays 5 or more consecutive days, they must register within 2 days of arrival. The Oklahoma DOC mails non-forwardable registration forms; recipients must return them in person within 10 days.

Residency and Location Restrictions

Oklahoma law bans registered sex offenders from living within 2,000 feet of certain locations. This rule has been in place since June 7, 2006. The distance is measured in a straight line, not by road. The restricted locations include:

  • Public or private schools (any grade level)
  • Licensed daycare or childcare centers
  • Public parks
  • Playgrounds
  • Any other licensed child care facility

In a rural county like Delaware, the 2,000-foot rule is easier to satisfy in many areas. But in Jay and Grove, the two largest towns, the restriction can limit where someone can legally live. Violating the residency restriction is a separate offense from failure to register. Always verify a specific address against current school and daycare locations before assuming it is compliant.

Note: The 2,000-foot rule applies to where an offender lives, not necessarily where they work. Some employment and other location restrictions may also apply depending on the specific offense. Check the full statute for details.

Delaware County Court Records

Sex offense convictions become part of the public court record in Delaware County District Court. You can look up case records through the Oklahoma State Courts Network at oscn.net. Search by name to find filings, charges, dispositions, and sentencing records. OSCN is free to use for basic lookups.

The Delaware County District Court handles criminal cases including all sex offense matters. The courthouse is in Jay. Court records may show the original charges, any plea agreements, and the final sentence. Keep in mind that the registry and the court record are separate systems. An offender may appear in the registry without detailed court records being easily findable, and vice versa.

If you need certified copies of court documents, contact the Delaware County Court Clerk directly. There are fees for certified copies. For most public lookups, the free OSCN search is enough.
