Ottawa County Risk Levels

Oklahoma classifies sex offenders into three risk levels under 57 O.S. § 583. The system works the same in Ottawa County as statewide. Level 1 is low risk with annual check-ins for 15 years. Level 2 is moderate risk requiring semi-annual registration for 25 years. Level 3 is high risk with registration every 90 days for life.

Habitual offenders with two or more sex crime convictions register for life. Aggravated offenders do too. Both must check in every 90 days regardless of their level number. The DOC mails non-forwardable forms to each offender's last reported address. If the form comes back or goes unreturned for 10 days, the offender is considered out of compliance and an investigation begins. Ottawa County law enforcement tracks these violations closely given the county's position along state borders where offenders might try to slip between jurisdictions.

Note: Ottawa County's border location with Kansas and Missouri means offenders moving across state lines must register in each state where they reside.

Residency Restrictions in Ottawa County

Registered sex offenders in Ottawa County cannot live within 2,000 feet of schools, parks, playgrounds, daycares, or child care homes under 57 O.S. § 590. The distance is a straight line measurement. This has been the rule since June 2006.

In Miami, these buffer zones cover much of the town's residential areas near schools and parks. Commerce and other smaller towns have their own restricted zones. Rural parts of Ottawa County have fewer restrictions, but compliance must still be verified before an offender moves. The sheriff's office can confirm whether a specific address falls within a restricted area. Moving to a restricted zone or failing to report a new address within three days are both separate violations.

Registration in Ottawa County

Oklahoma has required sex offender registration since November 1, 1989, under 57 O.S. § 581-590.2. All offenders with qualifying convictions must register in the county where they live. Out-of-state offenders entering Ottawa County must register within two days if they plan to stay five or more consecutive days. Given Ottawa County's border position, this rule comes up often when offenders cross from Kansas or Missouri.
